Terms and Conditions: The use of this web site and/or premises of Blue Avenue and/or its affiliate dealers and franchises and/or its manufacturers and distributors and/or its sales agents (for simplicity we will refer to "Blue Avenue and/or its affiliate dealers and franchises and/or its manufacturers and distributors and/or its sales agents" as Blue Avenue) is regulated and governed by the policies, terms and conditions set forth below. By placing an order or purchasing a product from Blue Avenue indicates full understanding and acceptance of all of the terms and conditions set forth on this entire Policy web section. By surrendering or allowing goods or products for repair, whether the repair is warranty or not, and/or whether the purchase of these products originated from Blue Avenue or not, also indicates full understanding and acceptance of all of the terms and conditions set forth on this entire Policy web section. The terms and conditions herein shall supersede any existing and subsequent terms or conditions included with any purchase or repair order. Blue Avenue reserves the right to make changes, amendments or nullifications to any information on this Policy section and these terms and conditions at any time. Should there be any information on this Policy that's not clearly understood, Blue Avenue recommends assistance from legal professionals for clarification.

Disclaimer and Limitation of Liability as to Products Sold or Repairs Accepted:
Except as expressly stated herein, Blue Avenue makes no representations or warranties, either express or implied of any kind with respect to sales transactions or products sold on the Blue Avenue site and/or its premises. Except as expressly stated herein, Blue Avenue expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this web site or its premises, including but not limited to merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Blue Avenue, arising from any product sold on or as a result of the Blue Avenue site shall be the price of the product purchased or repaired. In no event shall Blue Avenue, its directors, officers, employees and representatives be liable for special, indirect, consequential, or punitive damages related to products purchased or repaired.
Purchaser herewith acknowledges and agrees Blue Avenue or the original distributor/manufacturer assumes no liability for any equipment or product and herewith assumes the risk of any injury arising from operation of any products offered on this web site and/or its premises. The original owner (person or business entity who purchases from Blue Avenue or the original distributor/manufacturer/agent) will indemnify and hold Blue Avenue or the original distributor/manufacturer harmless and take full responsibility for all safety warnings, instructions, and limited warranty if unit is sold, lent or otherwise transferred and will indemnify Blue Avenue or the original distributor/manufacturer, it's officers, agents or assignees from any claims against failure to do so.
Blue Avenue or the original distributor/manufacturer's, sole obligation under this warranty is to replace or repair, at it's option, any part found to be defective. Parts replaced or repaired under this warranty are warranted only for the balance of the Standard Comprehensive Warranty period or the balance of the Extended Warranty period. All defective parts replaced under warranty become the property of Blue Avenue or the original distributor/manufacturer. For warranty repairs, the customer agrees to arrange and pay incurred shipment/courier fees for the defective part in question and is responsible for the delivery or drop off and pick up of your product to Blue Avenue. For warranty repairs, under its discretion, Blue Avenue may incur the shipping cost of the replacement part to the customer. This limited warranty is in lieu of all other warranties, standard or extended. Any implied warranty of fitness for a particular purpose, merchantability or otherwise, is specifically rejected or denied. Some states and/or provinces do not allow how long an applied warranty lasts so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have additional specific legal rights that vary state to state or province to province.

Refund/Exchanges: ALL SALES ARE FINAL AND WE DO NOT ACCEPT RETURNS FOR REFUNDS. However, Blue Avenue does allow credit or exchange for other items if the original item purchased is unwanted. If the product has been used, ridden, or damaged while in the possession of the customer, the product cannot be exchanged or returned for future credit, unless authorized by Blue Avenue, at a lower value than the purchase price.

Extended Warranty - Silver and Platinum
Silver - Comprehensive Warranty is extended another 6 months in addition to the standard Comprehensive Warranty coverage for a total of 1 year coverage of parts and labour from the date of delivery on all Manufacturer's defective parts but not including batteries.
Platinum - Comprehensive Warranty is extended another 12 months in addition to the standard Comprehensive warranty coverage for a total of 18 months coverage of parts and labour from the date of delivery on all Manufacturer's defective parts but not including batteries.

Comprehensive Warranty covers manufacturer's defects of all parts and labour for one year not from the time of purchase but from the time of delivery. Coverage includes powertrain, controller, and all electrical and mechanical parts, except for batteries and battery chargers for which there is a six month warranty coverage. Plastic parts, flat tires if punctured, light bulbs, wear and tear, lack of maintenance, accidents or collisions, misuse, abuse, neglect, damage incurred from floods, salt and other foreign debris or chemicals, and extreme cold temperatures are not covered by the comprehensive warranty.
Your warranty is covered by the Pre-Delivery Inspection and Assembly Charge (PDI). If PDI/Assembly is not taken then there is no Comprehensive Warranty Coverage, however, a 7-days Parts Warranty will be included. Allow for a minimum of 24 hours for PDI/Assembly, at which time test and trial runs are conducted on the products to ensure all systems are safe and operable. Allow for at least 24 hours for warranty and estimate examination, and at least 5 business days for repair.

Parts Warranty - Online/Internet/Telephone Purchases
Comprehensive Warranty coverage does not pertain to purchases made over the internet or telephone. 7-day Parts Warranty is given to all crated or boxed units from the date of receiving the shipment. If accepted for Parts Warranty, we may at our option, 1) exchange or repair the malfunctioning part without receiving the part back from the customer, 2) exchange or repair the malfunctioning part after receiving the part back from the customer or 3) have you take the product to an affiliate dealer, where the repair will take place at your cost. We may also require a video or photo of the parts in question before making our decision on the acceptance of warranty. Returned parts must be 100% complete. The products we sell are partially unassembled and crated at the manufacturer's factory. We may assemble it at our discretion, depending on the nature of the purchase agreement. In any case, the products are intended to be fully operational, defect-free condition when they arrive at our warehouse and are shipped to you, but occasionally there may be minor adjustments that must be resolved during setup and vehicle prep. If, for example, your product has a defective part that needs replacing. Under the 7-day Parts Warranty program, a replacement part will be sent at our cost, but you'll be responsible the shipping cost incurred sending the original part in question, an you will be responsible for removing the defective part, installing the new part, and making the proper assembly so that it will operate smoothly and safely. If you're not capable of assembly, you'll be responsible for bringing the product to a mechanic and paying for the cost of repair or assembly.

Typographical Errors: In the event that Blue Avenue mistakenly listed at an incorrect price for a product, Blue Avenue reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price. Blue Avenue reserves the right to refuse or cancel any such orders whether or not the order has been confirmed by any means of payment. Blue Avenue shall issue a credit to your credit card/debit card account or by cash/cheque in the amount of the incorrect price for which a payment is made.

Shipping: Online or store orders are processed within 24 hours of receipt and shipped within 1 to 3 business days thereafter. Orders are shipped via the shipping method chosen by Blue Avenue. Please allow between up to 10 business days for delivery (Monday through Sunday). We do not ship on Saturdays, Sundays, or Holidays. Any orders placed on Saturday or Sunday will be processed the next business day. Once your order has been shipped you will be notified via email or fax. You will receive a tracking number in your email or fax so you can track your package.
Some shipping delays are beyond our control such as weather and delivery errors. In order to ensure your order arrives promptly please review all the information, such as your mailing address and contact numbers, submitted before processing orders. Packages shipped with an incorrect address provided by the customer are subject to a $10.00 non-refundable correction fee, which involves the cost of handling and care but not the cost of postage of re-shipping. Customer is subsequently responsible for shipping and handling charges in order to reship your package. Occasionally, an item will be out of stock. Out of stock orders will be held "open" until item is restocked and will be shipped immediately upon arrival.

All refused shipments of products initially purchased by customers without any reason that is satisfactory to Blue Avenue, will be charged the cost of shipping both ways on their credit cards or other means. An example of a satisfactory reason that would not incur cost to the customer would be the apparent damage to the packaging and the products as witnessed by the shipper in writing only on the weigh bill. An example of an unsatisfactory reason would be if the customer is leaving the country for any reason. Whatever the reason is for refusal, Blue Avenue, will decide whether the reason has reasonable grounds or not. Upon receiving the shipment in good order, some assembly may be required such as tightening all screws and nuts and bolts, adjusting the chain, installing the pedals, storage box, tightening the steering or handlebar and installation and tightening of the front or rear wheels. Before any operation you may be required to run some testing for your safety, such as, ensuring all electrics and mechanics are operable such as the headlights/tail lights, signal lights, horn, speedometer, and brakes. You will also be required to put air in the tires and to fully charge the batteries. We are not responsible for chains that may come off during operation and the damage they may cause. The chain will stretch over time and you, the operator, must routinely check it and make proper adjustments when needed. We are not responsible for small scratches, dings, small dents, etc. Most scratches can be fixed with touch up paint that can be purchased at your local paint store.
